2. The petitioner seeks regular bail in connection with Barun P.S. Case No. 281 of 2025 registered for the offence under Sections 96, 137(1)(b) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 05.06.2025.

5. Learned A.P.P. for the State has vehemently

6. Though the allegation against the petitioner is of kidnapping the victim girl but from the statement of the victim girl recorded under Section 183 BNSS, it appears that the victim girl had eloped with the petitioner on her own.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad/concerned Court below in connection with Barun P.S. Case No. 281 of 2025.
