The petitioner seeks bail in a case registered for the offence punishable under Sections 379, 411, 401, 414/34 of the Indian Penal Code.

The prosecution case in brief is that informant of this case was going to market from his house for purchasing house hold articles on 08.07.2019 at 12.00 PM and when he reached at Kolhua Chowk and took a three wheeler came in which persons were already sitting. The informant also took hid seat and when he reached at Bairia Golambar and told to get down and wait there and driver of three wheeler tried to fled away towards Purani Road. The informant saw that the money Rs. 11,000/-

Patna High Court CR. MISC. No.68100 of 2019(3) dt.04-12-2019 2/2 was missing. He raised alarm. Motorcycle riders chased him and caught them. The apprehended person told his name as Sanjeet Kumar and three wheeler told his name Anand Kumar and they told the name of escaped person as Sushil Kumar. In presence of witnesses search was made and from possession of Sanjeet Kumar said amount was recovered.

Learned counsel for the State submits that there is recovery of the said amount from the conscious possession of the petitioner. Learned counsel for the petitioner submits that there is no specific allegation against the petitioner. The petitioner is in custody since 09.07.2019 and has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 814 of 2019.
