1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Athmalgola P.S. Case No. 117 of 2024 dated 05.04.2024 registered for the offence punishable under sections 25(1-B)(a), 26 & 35 of the Arms Act.
3. As per the prosecution case on 05.04.2024 at around 8:00 A.M. the informant got the statement of Vicky Kumar recorded who is an accused in Athmalgola P.S. Case No. 116 of 2024. On the basis of the statement made by Vicky Kumar, the Police Officer (informant) conducted raid in the house of the petitioner. Upon search of the petitioner's house, two guns i.e. one groove gun and one double barrel gun with five live cartridges were recovered.

Ms. Nivedita Nirvikar, learned senior counsel for the petitioner argued that the petitioner has falsely been implicated on the basis of confessional statement of the coaccused Vicky Kumar, who is his nephew. She further argued that the house from where the fire arms have been recovered is a joint family house in which the petitioner along with other family members including Vicky Kumar also resides and the said Vicky Kumar has been granted regular bail by this Court.
5. I have heard learned counsel for the parties and have gone through the materials on record. From perusal of the first information report it appears that two fire arms along with live cartridges have been recovered from the house of the petitioner one of which is a one barrel gun and the second is a double barrel gun. The seizure list specifically shows recovery from the house of Bijli Yadav i.e. the petitioner. The prima facie material shows recovery from the house of the petitioner. The petitioner is having one criminal antecedent of similar nature of offence. Accordingly, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected.
