KUMAR ORAL ORDER 06-09-2018 Heard learned counsel for petitioners, learned counsel for informant and learned counsel for the State. Petitioners are apprehending their arrest in connection with Complaint Case No. 244C of 2016 for the offences registered under Sections 498A and 406 of the Indian Penal Code.
Complainant in his complaint case has alleged that her marriage was solemnized with the son of petitioner No. 1 about 14 years ago and from said wedlock she was blessed with two daughters and one son. Her husband was deaf and physically weak. She alleged that her husband met an accident on 02.10.2015 at Gajiyabad and petitioner No. 2 took his death
Patna High Court Cr.Misc. No.31272 of 2018(3) dt.06-09-2018 2/2 compensation amount and did not give any money to her. It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case due to family property dispute. Petitioner No. 1 is the father-inlaw and petitioner No. 2 is the brother-in-law of the complainant. It has been further stated that her husband died on 02.10.2015 but the instant case has been filed on 04.07.2016. Learned counsel for the informant vehemently opposes the prayer for bail.
Considering the facts and circumstances of the present case, let petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned court below, Supaul in connection with Complaint Case No. 244C of 2016, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
