JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-08-2018 The petitioner is apprehending his arrest in connection with Saharghat P.S. Case No. 132/2017, registered for offences punishable under Sections 341, 323, 354 (B) of the Indian Penal Code.
Allegation against the petitioner is that he tried to outrage the modesty of the informant.
Submission of learned counsel for the petitioner is that the petitioner and complainant earlier have solemnized marriage, which will appear from para-17 of the case diary. Further submitted that the petitioner has falsely been implicated in this case.
Heard learned A.P.P. as well as learned counsel for the
Patna High Court Cr.Misc. No.45002 of 2018 (4) dt.29-08-2018 2/2 informant, they have opposed the prayer for anticipatory bail of the petitioner by stating that he was earlier also accused in similar type of case, which will appear from para-3 of the petition itself and the petitioner is a habitual of committing such type of act. Having heard both sides, in view of the facts and circumstances of the case as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner rather he should surrender before the court below and make prayer for regular bail, which will be considered on the merit of the case. Accordingly, this application is dismissed.
