Petitioner apprehends his arrest in a case registered for the offence punishable under Section 380, 454 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, this petitioner along with other accused persons committed loot in the house of informant and forcibly took away Rs. 1,19,000/- and some ornaments from the house of informant.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case due to village politics. Petitioner and informant are next door neighbours. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent.

No.66094 of 2022(4) dt.12-05-2023 2/2 Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that petitioner has been identified by the informant and there is direct and specific allegation against him that he along with other accused persons committed loot in the house of the informant. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on pre arrest bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
