2. The petitioner apprehends his arrest in Mahila P.S. Case No. 51 of 2021, registered for the offences punishable under Sections 341, 354(B), 504, 506 of the Indian Penal Code.

3. As per the prosecution case, minor daughter of the informant who was deaf-and-dumb was sexually assaulted by the petitioner.

4. It is submitted by the counsel for petitioner that petitioner is innocent and has committed no offence. Both parties are close door neighbour and due to petty dispute petitioner has been falsely implicated in this case. Petitioner claims clean antecedent.

5. Counsel for State however vehemently opposed the prayer for bail and submitted that the victim girl in her

Patna High Court CR. MISC. No.74754 of 2022(4) dt.08-09-2023 2/2 statement under Section 164 Cr.P.C has duly supported the prosecution case and medical report also corroborates the prosecution case.

6. Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
