2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No. 797 of 2023 connection with Muffasil P.S. Case No. 194 of 2023 dated 04.04.2023 registered for the offence punishable under Sections 302, 201 and 120B read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner along with other co-accused person is alleged to have killed the brother of the informant on account of previous dispute of wife of the petitioner and the dead body was disappeared in the

Patna High Court CR. MISC. No.67775 of 2023(2) dt.18-10-2023 2/2 garden of Bari Eghu.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case on mere suspicion. The other co-accused person has already been granted bail by the Co-ordinate Bench vide order dated 16.08.2023 passed in Cr. Misc. No. 50532 of 2023. There is general and omnibus allegation against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 10.04.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in Sessions Trial No. 797 of 2023 connection with Muffasil P.S. Case No. 194 of 2023.

7. The application stands allowed.
