JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 The petitioner seeks regular bail in connection with Dhoraiya P.S. Case No. 98 of 2019, registered for offences punishable under Sections 30(a) and 32(2) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 144 litres of country made liquor.

It has been submitted on behalf of the petitioner that he has no criminal antecedent and has been in judicial custody since 05.06.2019.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for more than five months, as such, let the petitioner

Patna High Court CR. MISC. No.74098 of 2019(3) dt.25-11-2019 2/2 above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II, Banka, in connection with Dhoraiya P.S. Case No. 98 of 2019 subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the Trial Court.
