2. Petitioner apprehends arrest in connection with Motipur P.S. Case No. 263 of 2022 registered for the offences under Sections 30(a)/32(i)(ii)/36/41(i) of Bihar Prohibition of Excise Act, 2018.

3. Learned counsel for the petitioner submits that similarly situated co-accused persons have already been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 16.11.2022 passed in Cr. Misc. No. 60556/2022 as contained in Annexure '2 series' to the petition. Further he submits that petitioner has no criminal antecedent.

4. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the

No.68091 of 2023(2) dt.01-11-2023 2/2 petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.1,000/- (Rupees one thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Court No. II, Muzaffarpur in connection with Motipur P.S. Case No. 263 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
