1. Heard the parties.
2. Petitioner seeks regular bail in connection with Baligaon P.S. Case No. 135 / 2022 registered under Section 363, 366(A) / 34 of the I.P.C. and Section 8, 12, 18 of the POCSO Act.
3. As per the prosecution case on 13.12.2022 the daughter of the informant was missing from the home and upon search she got the information that his co-villager / Ramesh Sahni i.e. the petitioner along with other accused persons had kidnapped her daughter after alluring her for the purpose of marriage.
4. Learned counsel for the petitioner submits that there was love relationship between the petitioner and the victim girl from before. The victim girl is aged about 19 years and twice fled
Patna High Court CR. MISC. No.71445 of 2024(5) dt.06-08-2025 2/3 away with the petitioner. She returned back to her parental home and her statement under Section 161 & 164 Cr.P.C. was recorded wherein she has denied the allegation that she was kidnapped by the petitioner and others.
5. Learned counsel for the informant submits that the victim girl has not supported the prosecution story and solemnized marriage with the petitioner and out of the wedlock one child is born. The petitioner is in custody since 16.07.2024. Charge sheet has already been submitted and there is no likelihood that petitioner will abscond or tamper with the evidence if released on bail.

Regard being had to the submissions made by the parties, taking into consideration the statement of the victim girl recorded under Section 161 & 164 Cr.P.C., the fact that petitioner is in custody since 16.07.2024, charge sheet already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, accordingly I am inclined to grant regular bail to the petitioner.
7. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge- VI cum Special
