The petitioner seeks pre-arrest bail in connection with Buxar (industrial) P.S. Case No. 76 of 2019, pending in the Court of the Chief Judicial Magistrate, Buxar, registered under Sections 341, 323, 307, 406, 420 and 34 of the Indian Penal Code and 27 of the Arms Act.

The accusation is that informant, Gopal Prasad Srivastava, along with his son, went to see his land situated in front of Carmel School, then, saw that Abhishek Gaurav Pandey, with this petitioner, with intention to grab the land have collected the bricks. When informant made protest, then, all caught hold to his son, Mihir. At that time, this petitioner fired through pistol causing injury at left hand and left thigh. Patna High Court CR. MISC. No.62451 of 2019(2) dt.17-10-2019 2/2 case, I am not inclined to grant the privilege of pre-arrest bail to the petitioner. The prayer for pre-arrest bail is rejected. The petitioner is directed to surrender before the Court below and seek regular bail, which will be considered on its own merit and without being prejudiced of this order.
