JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Banka P.S. Case No. 139 of 2014, registered for the offences punishable under Sections 304 (B) 34 of the Indian Penal Code.

Petitioners are happens to be father-in-law and mother-in-law in a case under Section 304 (B) IPC. It further appears that finding case untrue against the petitioners police has filed final form against them but on protest petition cognizance has been taken against them.

Submission of the learned counsel for the petitioners is that there is general and omnibus allegation alleged against the petitioners. Moreover, after completion of investigation

Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, 1st Class, Banka in connection with Banka P.S. Case No.-139 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
