In view of the above, the application for anticipatory bail on behalf of the petitioner no.1 is dismissed s withdrawn. The withdrawal of the application for anticipatory bail will not cause any prejudice to petitioner no.1 if he appears before the court below and prays for regular bail on surrender. The Court below is directed to dispose of the application of the regular bail of petitioner no.1on the same day on its own merit without being influenced by the dismissal of anticipatory bail application by this Court.

No.54570 of 2018(3) dt.12-12-2018 2/2 Considering the allegation against petitioner no.2 who is apprehending arrest in connection with Complaint Case No. 65C of 2017 for the offence under sections 504, 323, 379 and 554 of the Indian Penal Code, let the petitioner No.2, namely Kishori Yadav, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Jamui, in connection with Complaint Case No. 65(C) 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C.
