2. The petitioner has preferred this application for grant of regular bail in connection with Tedhagachh P.S. Case No. 96 of 2025 registered for the offences punishable under Sections 331(4) and 305 of the BNS.
3. Prosecution case, in short, is that unknown persons committed theft in the house of the informant by breaking the lock. It is alleged that gold ornaments worth Rs. 1,67,000/-, Aadhar Card, other documents alongwith other belongings were stolen.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case merely on the basis of suspicion and due to local village

Petitioner is not named in the F.I.R. during the course of investigation, allegation against the petitioner is that he along with other accused persons, who are also not named in the F.I.R. committed trespass in house of the informant and looted the cash, jwellery after breaking the lock of Godrej Almirah. Petitioner has categorically denied about the allegations levelled against him and he has no connection with the alleged occurrence. Learned counsel further submits that nothing has been recovered from his possession. The ornaments contained in seizure list are not mentioned in the F.I.R. as stolen article and petitioner has never been put on Test Identification Parade. It is also submitted that other co-accused namely, Taslimuddin has been granted bail by a Co-ordinate Bench of this Court vide order dated 09.09.2025 in Cr. Misc. No. 61967 of 2025. Petitioner is in custody since 11.06.2025.
5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Keeping in view the aforesaid facts and considering the period of custody undergone by the petitioner, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of

Case No. 96 of 2025 subject to the following conditions :- (i). Petitioner will remain physically present in trial on each and every date till the disposal of the case failing which, on two consecutive dates without reasonable cause, the bail bond of the petitioner may be cancelled by the Trial Court.
