2. The petitioner has earlier moved before this Court with a prayer for anticipatory bail which was rejected vide order dated 11.07.2025 passed in Cr. Misc. No. 41521 of 2025.
3. The petitioner seeks bail in connection with Khusrupur P.S. Case No. 401 of 2024 instituted for the offence under Sections 80, 103(1), 238, 61(2) of the Bharatiya Nyaya Sanhita, 2023.
4. The prosecution case, in short, is that daughter of the informant was done to death by her in-laws due to nonfulfillment of the demand of dowry.
5. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.68681 of 2025(4) dt.31-10-2025 2/3 petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. The petitioner is not named in the F.I.R. and is uncle of the deceased's husband. There is no specific or direct allegation of any overt act against the petitioner rather the same is general and omnibus in nature. The specific allegation is against the husband of the deceased. The husband of the deceased is already in judicial custody. Learned counsel for the petitioner further submits that the petitioner is not the family member of the victim rather has only helped in the disposal of the dead bodies of the deceased and her child. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent and is languishing in judicial custody since 24.07.2025 without any rhymes or reason.
6. Learned counsel for the petitioner again submits that the co-accused persons namely Baijnath Singh and Mahendra Yadav have already been granted bail by this Court vide orders dated 21.03.2025 and11.07.2025 passed in Cr. Misc. Nos. 16433 of 2025 and 33431 of 2025 respectively.
7. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner and the petitioner having no criminal antecedent, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Khusrupur P.S. Case No. 401 of 2024.
