1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Awtar Nagar P.S. Case no.64 of 2025, registered under sections 126(2), 115(2), 118(1), 109, 303(2), 351(2), 351(3) and 352 of the Bhartiya Nyaya Sanhita, 2023.

3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. As per instructions received, the matter has been settled between the parties in the learned Court below and the informant is not interested in pursuing the case.

4. The application for anticipatory bail is opposed by learned A.P.P. for the State.

5. Learned counsel for the petitioner seeks permission

Patna High Court CR. MISC. No.65152 of 2025(2) dt.17-09-2025 2/2 to withdraw this application to enable the petitioner to move the learned trial Court for grant of regular bail.

6. The application stands disposed of as withdrawn.

7. The petitioner is directed to surrender in the learned Court below within a period of four weeks.

8. In case the petitioner so surrenders within the aforesaid period and moves for regular bail, the same shall be considered without being prejudiced by this order of withdrawal/rejection and the learned Court will take into consideration the joint petition filed by the petitioner and the informant.
