2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 419, 420, 409 of the Indian Penal Code.

3. As per FIR, on 12.08.2023 a secret information was received that in the private building of Sri Manoj Dubey situated at Belwatiya Pokhar, Bhabhua a parallel revenue office work was going on illegally. After receiving information a raid was conducted and revenue officer, co-accused persons including the petitioner were found present there in working mode with confidential documents of revenue sections after that this case has been lodged.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

The petitioner is a government employee, who is posted as Halka Karamchari (Revenue Staff) of Jagbraw and Kaithi Panchayat rather due to suspicion he has falsely been implicated in this case. The petitioner has not cheated by personating or cheating therefore Sections 419, 420 and 409 of the Indian Penal Code are not made out against the petitioner. It is further submitted that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 13.08.2023.

5. Learned APP appearing for the State has vehemently opposed the prayer of Bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bhabhua P.S. Case No. 743 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua.
