====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing on behalf of the State.
2. The petitioner apprehends his arrest in a case registered for offences punishable under Sections 304(B) and 34 of the Indian Penal Code.
3. It is a case of 'dowry death'.
4. The petitioner is the brother-in-law of the deceased. The allegations are general and omnibus in nature. The thrust of the accusation is against the husband of the deceased, who is already in custody since 13.09.2024. The petitioner is separate in mess and property and has no concern with the family affairs of the deceased and her husband.
5. Learned A.P.P. for the State has vehemently
Patna High Court CR. MISC. No.65302 of 2025(2) dt.05-12-2025 2/2 opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the aforesaid facts and circumstances, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest or surrender within a period of eight weeks from today, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Basantpur (L.N.G.) P.S. Case No. 302 of 2024, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
