JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-10-2019 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State. Petitioners apprehend their arrest in connection with Raniganj P.S. Case No.443 of 2018, for the offence punishable under Sections 147, 148, 149, 341, 323, 332, 353, 504, 506 of the Indian Penal Code.

The allegation against the petitioners as per the First Information Report is that during the process of selection of Aanganbari Sewika, Rupam Kumari was deputed as women supervisor and started selection procedure and one candidate, Chandrika Kumari, was selected for the post of Aanganbari Sahayaika. It has further been alleged that one candidate

No.61140 of 2019(2) dt.15-10-2019 2/3 namely, Sharmila Devi, was not selected for the said post and she along with her sister attempted to snatch the documents from the possession of the supervisor and when the police force present there restrained her to do so, the petitioner along with 25-30 unknown persons armed with deadly weapons attacked on the police force with intent to kill them and started abusing and scuffling them.

Mr. Mukesh Kumar, learned counsel appearing for the petitioners submits that altogether 26 persons are named in the First Information Report along with 25 to 30 unknown persons and the allegation against the petitioners are general and omnibus in nature. Learned counsel further submits that similarly situated accused persons have been granted bail by this Court in Cr. Misc. No.37295 of 2019.

Having regard to the submissions made by the parties and taking into consideration the fact that general and omnibus allegation has been levelled against the petitioners in the First Information Report and similarly situated persons have been granted bail by this Court, I am inclined to grant anticipatory bail to all these petitioners.

Accordingly, the petitioners, above named, are directed to surrender before the learned Court below within a

No.61140 of 2019(2) dt.15-10-2019 3/3 period of four weeks from today and in the event of surrender by them, they shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
