1. Heard learned counsel for the Petitioners and learned APP for the State

2. The Petitioners apprehend their arrest in connection with Barh P.S. Case No. 387 of 2023 dated 22.06.2023 registered for the offences punishable under Sections 341, 323, 379 and 307 read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The main submissions advanced by learned counsel for the petitioners are that the allegation made against the petitioners in the FIR is general and omnibus, both the parties are agnates and admittedly, a land dispute was running in between them when the alleged occurrence is stated to have taken place, in fact, the prosecution party brutally assaulted one

Patna High Court CR. MISC. No.72500 of 2023(2) dt.09-11-2023 2/2 namely, Babita Devi who happens to be relative of the petitioners regarding which Barh P.S. Case No. 389 of 2023 was lodged and injury report of the said Babita Devi has also been filed as Annexure-3 and no one on the prosecution's side sustained any injury in connection with the alleged occurrence detailed in the FIR of the present matter and both petitioners have got no criminal antecedent.

4. Learned APP appearing for the State has opposed the prayer for bail of the petitioners.

5. Considering the above submissions, this Court is inclined to accept the prayer for anticipatory bail of the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Barh P.S. Case No. 387 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
