2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 379, 325, 307, 506/34 of the Indian Penal Code.
3. As per the prosecution case, all the nine F.I.R. named accused persons including these two petitioners, armed with sword, sabal, knife and khanti were constructing drainage on the land of informant and when the mother of informant opposed, all the accused persons assaulted her alongwith other family members, as a result of which, four persons sustained injuries.
4. It is submitted on behalf of petitioners that on
Patna High Court CR. MISC. No.69404 of 2023(2) dt.01-11-2023 2/2 account of pending land dispute between the parties, a casual Mar-pit took place, in which, both sides sustained injuries. There is case and counter case. The injuries caused by these two petitioners have been found to be simple in nature. Petitioners are ladies and have got clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad (Bihar) in connection with Obra P.S. Case No. 169 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
