The petitioner apprehends his arrest in Mohammadpur P.S. Case No.124 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant on the basis of the information received from Munna Shahi searched a hut said to have belonged to the petitioner situated far away from the house of the petitioner and recovered 0.72 litre of Indian made foreign liquor.

Learned counsel for the petitioner submits that Munna Shahi and his men lodged Mohammadpur P.S. Case No.122 of 2019 on 20.07.2019. The hut is situated far away from the house of the petitioner and it was Munna Shahi who informed the

Patna High Court CR. MISC. No.60591 of 2019(2) dt.17-10-2019 2/2 police that liquor was kept in the hut. The petitioner never kept liquor in the hut rather it appears from the contents of the FIR that it was Munna Shahi and his men who had kept liquor in the hut and informed the police only to implicate the petitioner. Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Gopalganj in connection with Mohammadpur P.S. Case No.124 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
