Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehend arrest in connection with Gopalpur P.S. Case No. 89 of 2021 registered for the offences under Section 307 and other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case due to land dispute. Further submission is that there is allegation of firing but it did not cause any gun shot injury. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the

Patna High Court CR. MISC. No.67268 of 2023(2) dt.19-10-2023 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of J.M. 1'st Class, Patna in connection with Gopalpur P.S. Case No. 89 of 2021, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
