JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-02-2020 Heard learned counsel for the petitioner as well as learned counsel for the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406/420 of the Indian Penal Code.

Informant alleges that he had given Rs.5 lacs to the petitioner for developing business which was returned by the petitioner in the form of three cheques, out of which two cheques were bounced.

Learned counsel for the petitioner submits that the petitioner has already returned informant's money but it was the informant who did not return his cheques, handed over to the informant at the time of returning the money. Said cheques were submitted in the bank for withdrawal after lapse of three years. Learned counsel for the informant submits that the petitioner took money in goodwill but he did not return the same.
