2. The petitioner has preferred this application for grant of regular bail in connection with Sripur P.S. Case No. 193 of 2024 dated 24.10.2024 registered for the offences punishable under Sections 318(4), 338, 336(3), 340(2) read with Section 3(5) of the B.N.S.
3. As per the prosecution case, the petitioner in conspiracy with the other co-accused persons who are land mafia entered into a fraudulent deed dated 06.07.2024 and 08.07.2024 to grab the informant's land. Further, the land was transferred in the name of the co-accused, Yogendra Chaudhary
Patna High Court CR. MISC. No.65115 of 2025(2) dt.13-10-2025 2/3 who had no connection with the land or the informant family.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that till date mutation has not been done of the said land which also creates suspicion on the entire allegation as almost 35 years has been passed of division of property between the informant and his brothers. It is further submitted that the petitioner's grandfather doesn't have any son and taking the advantage of this, the informant and his associates illegally acquired all the land of the petitioner's grandfather. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 24.05.2025. The co-accused person has already been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 25.09.2025 passed in Cr. Misc. No. 62942 of 2025.
5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond
Patna High Court CR. MISC. No.65115 of 2025(2) dt.13-10-2025 3/3 of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Gopalganj in connection with Sripur P.S. Case No. 193 of 2024, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
7. The application stands allowed.
