The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 364 and 120B of the Indian Penal Code.

The allegation against the petitioner along with others is of abducting the son of the informant namely, Sikandar Kumar, later on he died.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He submitted that the there is no consistent evidence, no direct allegation against the petitioner and other persons to commit the offence, only on the basis of suspicion, the petitioner along with others have been

Patna High Court CR. MISC. No.65822 of 2022(3) dt.04-04-2023 2/2 implicated in the present case. There is no eye-witness of abduction and commission of murder to the deceased by the petitioner. He has got no criminal antecedent as stated in para-3 of the bail petition. The petitioner is languishing in judicial custody since 15.06.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Shahkund P.S. Case No. 159 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Bhagalpur.
