1. Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 118(1), 118(2), 109 103, 351(2), 352 and 3(5) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that petitioner along with named accused persons came and started abusing the informant, further Yusuf and Raj Ali caught hands of Md. Ayub, brother of informant, and Taufiq assaulted him indiscriminately by knife causing injury on chest and leg, thereafter Taufiq assaulted Sikandar who came to save
Patna High Court CR. MISC. No.65536 of 2025(2) dt.25-09-2025 2/3 Ayub causing injury on abdomen and head, thereafter injured were taken to hospital and Ayub was declared dead while Sikandar was referred to PMCH.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of stabbing is against Taufiq. It is also submitted that petitioner is not alleged to have even caught the hand of Md. Ayub.
5. Learned A.P.P. for the State and the learned counsel appearing on behalf of the informant opposes the prayer for anticipatory bail of the petitioner. Learned counsel appearing on behalf of the informant submits that from perusal of the allegation as alleged in the FIR, it would manifest that petitioner was also present at the place of occurrence and one person died on account of indiscriminate stabbing. It is next submitted that petitioner may not have stabbed the deceased, but then his presence at the place of occurrence along with other accused emboldened Taufiq to commit the occurrence.
6. Considering the submissions made by the learned APP for the State, the Court is not inclined to extend the
Patna High Court CR. MISC. No.65536 of 2025(2) dt.25-09-2025 3/3 privilege of anticipatory bail to the petitioner.
7. Accordingly, the instant anticipatory bail application stands rejected.
