2. The present writ petition has been filed for the following relief/s:- "I. For quashing the order contained in Memo no. 917 dated 15/05/2024 (annexed as Annexure-P/17) by which the Disciplinary Authority has passed order without considering the show cause, 2nd Show cause submitted by the petitioner and without examined any

Patna High Court CWJC No.15220 of 2024(2) dt.07-10-2024 2/2 witnesses and Disciplinary Authority passed punishment order on 15.05.2024 without examined any witness and it is against the eye of law as well as also ignoring the judicial pronouncement of the Hon'ble Courts."

3. After some arguments, Learned Counsel for the petitioner submits that permission may be granted to prefer appeal against the order challenged in the present writ petition.

4. Learned Counsel for the State submits that he has no objection if, petitioner prefers appeal.

5. Upon perusal of the records, it transpires to this Court that appeal to the petitioner lies under the Bihar Government Servant (Classification, Control & Appeal) Rules, 2005.

6. In the light of the submissions made by the parties, the present writ petition stands disposed off granting liberty to the petitioner to prefer appeal before the Appellate Authority. (Dr. Anshuman, J) Divyansh/- U
