JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Laxmipur P.S. Case No. 98 of 2017 registered for the offences punishable under Sections 121(A), 122, 120(B), 427, 431 of the Indian Penal Code and 16, 17, 18, 19, 20 and 21 of the U.A.P. Act.
Although, the petitioner is named in the first information report but the first information report reflects that the name of the petitioner came in written report of informant on the basis of confidential information. The case diary written up to 15.8.2018 has been received and in the case diary there is nothing against the petitioner. Petitioner does not have any
Patna High Court Cr.Misc. No.59525 of 2018(3) dt.14-12-2018 2/2 criminal antecedents, which is evident from paragraph no. 3 of the petition. Moreover, co-accused Nand Lal Kora and Bijay Kora have already been admitted anticipatory bail by different Benches of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addition Chief Judicial Magistrate-III, Jamui in Laxmipur P.S. Case No. 98 of 2017 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
