The petitioner seeks bail in connection with Parasbigha P.S. Case No. 77 of 2023 registered for the offence under Sections 30(a), 30(c) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
Learned counsel for the petitioner submits that the petitioner is in custody since 20.07.2023 and there is recovery of twelve litres of country made liquor from her possession. He further submits that she has two criminal antecedents of similar nature.
Learned APP has vehemently opposed the prayer of bail.
Patna High Court CR. MISC. No. 69469 of 2023(2) dt.01-11-2023 2/2 Considering the period of custody and recovery of liquor from her possession, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-Ist, Excise, Jehanabad in connection with Parasbigha P.S. Case No. 77 of 2023.
The petitioner will visit Parasbigha Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
