The petitioner has prayed for bail in a case registered for the offence punishable under sections 363, 365, 366A, 34 of the Indian Penal Code.

As per allegation in the FIR, several accused persons including the petitioner enticed away the minor daughter aged about 16 of the informant. It is further alleged that on very next date victim girl had called the informant and told her not to do anything otherwise her life would be in danger. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. FIR has been lodged after a delay of 12 days. Victim girl has performed marriage with accused no. 1, namely Golu Kumar and victim

Patna High Court CR. MISC. No.66610 of 2022(2) dt.18-03-2023 2/2 lady is living in her matrimonial home. There is no legal material available on record to show the complicity of the petitioner in the alleged crime. General and omnibus allegation has been levelled against the petitioner. She is a lady and languishing in judicial custody since 24.07.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts that petitioner is a lady, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMIX, Vaishali at Hajipur in connection with Desari (Sahdei O.P.) P.S. Case No. 272 of 2022.
