The petitioner is apprehending his arrest in connection with Fulkaha P.S.Case No.24 of 2019 registered for offences punishable under Sections 413, 414, 420/34 of the Indian Penal Code.

As per the FIR, the police arrested co-accused and on his confession, several accused persons were also named and from them stolen motorcycles were recovered and later on name of the petitioner also transpired on confessional statement of the co-accused.

Submission of the learned counsel for the petitioner is that save and except confessional statement of the co-accused there is nothing against the petitioner.

Heard learned A.P.P. , who has opposed the prayer for bail

Patna High Court CR. MISC. No.60672 of 2019(2) dt.24-09-2019 2/2 on the ground that the petitioner is accused in one more case. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of2019 this Court.

With the aforesaid direction, this application is dismissed.
