1. Though the present writ petition has been filed for setting aside the order dated 12.09.2018, passed by the District Arms Magistrate, Lakhisarai, whereby and whereunder the original copy of the application filed by the petitioner for grant of arms license has been returned back to the petitioner in order to enable him to file a fresh application, as per the New Arms Rules, 2016, nonetheless, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to file a fresh application, as per the provisions, contained in the Arms Rules, 2016, within a period of four weeks from today, however, seeks a direction upon the District Magistrate, Lakhisarai to consider

Per contra, the learned counsel for the respondentState submits that in case appropriate application is filed by the petitioner for grant of arms license, in accordance with the Arms Rules, 2016, the same would definitely be considered and disposed off within a stipulated time frame, as is fixed by this Court.

3. Having regard to the facts and circumstances of the case, I deem it fit and proper to grant liberty to the petitioner to file appropriate application for grant of arms license, as per the provisions contained in the Arms Rules, 2016 and in case such an application is filed within a period of four weeks from today, the same shall be considered by the District Magistrate, Lakhisarai, in accordance with law and disposed off within a period of eight weeks, thereafter.

4. The writ petition stands disposed off on the aforesaid terms.
