The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

Allegation against the petitioner is that he along with Jang Bahadur bitterly assaulted to the daughter of the informant as a result whereof she died during the course of treatment. Submission is that investigation of the case is already complete. Police has submitted charge sheet under Section 304 of the Indian Penal Code. Co-accused Jang Bahadur has already been allowed bail by a coordinate Bench of this Court. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail after framing of

No.60694 of 2019(2) dt.01-10-2019 2/2 the charge on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Pipra P.S. Case No.215 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
