Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 323, 324, 341, 307, 354, 379, 504 and 506 read with 34 of the Indian Penal Code.

As per the prosecution case, the petitioner and coaccused persons holing pistol and rifle came abusing and told to vacate the land. On being objected by the wife of the informant, all the accused persons started assaulting on the mouth and head

They also snatched silver ornaments. The informant further alleged that the accused Anshu Kumar is accused in the case of murder.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Learned counsel further submitted that the injury of the injured is stated to be simple in nature as per the Annexure 2 filed on behalf of the petitioner. The petitioner is accused in two other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 17.03.2021.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhepura in connection with Gamharia P.S. Case No. 151 of 2020 corresponding S.T. No. 176 of 2021.
