Heard learned counsel for the petitioners and learned APP for the State.
The petitioners are apprehending their arrest in a case registered under Sections 341, 324, 307/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case, in brief, is that on the order of petitioner No. 2, the petitioner No. 1 fired which hit on the left hand of the informant.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The
Patna High Court Cr.Misc. No.57296 of 2018 (3) dt.20-11-2018 petitioners have been falsely implicated in the present case. The injury is said to be on the non-vital part of the body. From perusal of Annexure-A of supplementary affidavit, it is evident that the matter has already been compromised between the parties. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 346 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
