The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 452, 307 of the Indian Penal Code and Section 27 of the Arms Act.

The informant is carrying matrimonial dispute with her husband and for that reason allegation is that in the midnight the petitioner and his father, who are younger brother and father of the husband of the informant came to the house of the informant along with others and they fired, causing injury at the neck of the informant. The Doctor has found simple and single injury on the neck. Allegation is not specific, as to whose fire had caused the said injury.

Learned counsel for the informant opposed the

Patna High Court Cr.Misc. No.59146 of 2018(4) dt.03-12-2018 2/2 prayer for anticipatory bail on the ground that a witness has stated before the Police that fire of this petitioner had caused injury.

There is no averment in the F.I.R. that villager was also there in the midnight in the house of the informant to witness the occurrence.

Considering the entire facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Makhdumpur Police Station Case No.246 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
