1. Heard learned Senior counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Bhabhua P.S. Case no. 743 of 2023, registered under sections 420, 419 and 409 of the Indian Penal Code.

3. As per the prosecution case, it is stated that on a secret information having been received a raid was conducted and it transpired that without any authorisation by the competent authority and without any explanation the accused persons including the petitioner herein, who happens to be a Halka Karmchari, were carrying out official work in a private residence.

3. Learned Senior counsel appearing for the petitioner submits that the petitioner is innocent and has been falsely implicated in the case. In fact, allegations in the FIR do not constitute any offence. The petitioner who is a Halka Karmchari is in custody since 13.8.2023 and has no criminal antecedent.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR against this petitioner, his being in custody since 13.8.2023 and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Bhabhua P.S. Case no. 743 of 2023, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabhua, DistrictKaimur.
