The petitioners in the present case are seeking setting aside of the order dated 04.12.2017 passed by learned Sessions Judge, Kaimur in Cr. Appeal No. 88 of 2016 by which the order dated 03.10.2016 passed by learned A.C.J.M.-IV, Bhabua in Domestic Violence Case No. 796 of 2016 registered for the offence under Section 23 of the Protection of Women's from Domestic Violence Act, 2005 awarding Rs.1500/- per month interim maintenance amount in favour of O.P. No. 2 has been
Patna High Court CR. REV. No.1135 of 2018(7) dt.06-09-2022 2/2 affirmed.
Considering the fact that the petitioners are in possession of the joint family properties in which the opposite party no. 2 has also got a share and she is entitled for her maintenance, this Court is not inclined to interfere with the impugned judgment.
This application is dismissed.
