This application, for grant of anticipatory bail, arises out of Sheosagar Police Station Case No.162 of 2019, disclosing offences under Sections 341, 323, 307, 354/34 of the Indian Penal Code.

The allegation against the petitioner, on the basis of the written report of one Ashok Kumar Gupta, is that petitioner has assaulted the informant by means of iron rod on his head. Learned counsel for the petitioner submits that both the parties are neighbours and incident has taken place on the point of cleaning of the drainage in front of the shop of the informant. Learned counsel referring to Annexure 2 submits that injury caused to the informant has been found simple in nature.

No.65207 of 2019(2) dt.25-10-2019 2/2 Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both parties are neighbours and the dispute has taken place on a trivial issue and injury caused to the informant has been found simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.

This application is, accordingly, allowed.

Let the petitioner, Gobind Paswan, in the event of his arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Rohtas, Sasaram in connection with Sheosagar Police Station Case No.162 of 2019, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
