2. The petitioner apprehends his arrest in connection with Baikunthpur P.S. Case No. 148 of 2023 registered for offences under Sections 302, 341, 323, 342, 504, 201/34 of the Indian Penal Code.

3. As per the F.I.R., suspicion has been raised by wife of deceased against all the family members and even some villagers including the petitioner that they have killed the deceased and cremated his dead body.

4. Learned counsel for the petitioner submits that the petitioner is co-villager and is not related with the family of the deceased. There is no evidence against the petitioner of having participated in the killing of the deceased. The petitioner may have participated in the cremation of the deceased.

5. Learned APP for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for anticipatory bail is allowed.

7. Accordingly, let the petitioner, above-named, in the event of his arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj/concerned court below in connection with Baikunthpur P.S. Case No. 148 of 2023 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
