JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Itarhi P.S. Case No. 177 of 2018 registered for the offences punishable under Sections 341, 323, 498A, 494, 504/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

As per FIR there is allegation against the petitioner that he tortured the informant with respect to demand of dowry and there is also allegation that he solemnized second marriage with another lady.

Submission of learned counsel for the petitioner is that he is ready to keep her with dignity and care and the allegation is false and concocted. On the other hand, learned

Patna High Court CR. MISC. No.63413 of 2018(7) dt.04-11-2019 2/2 counsel for opposite party No.2 has opposed the prayer for anticipatory bail on the ground that petitioner has solemnized second marriage with another lady and as such it is not possible for her to reside with the petitioner.

Earlier a report was called for by a co-ordinate Bench of this Court regarding second marriage of the petitioner with another lady and the report disclosed that petitioner has solemnized second marriage with another lady. Heard learned APP also.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

Hence, this application is dismissed.
