Petitioner seeks regular bail in connection with Gwalpara (Ara O.P.) P.S. Case No. 15 of 2021 registered for the offence punishable under Section 392 of the Indian Penal Code. As per the prosecution, the informant alleged that two unknown miscreants snatched his motorcycle, mobile phone, a cash of Rs. 9700/- and some cards.
The main submissions advanced by the learned counsel for the petitioner are that the petitioner has been languishing in jail for about last two years and no recovery of any looted articles concerned to the present matter was made from the possession of this petitioner, though as per the order impugned the motorcycle is stated to have been recovered in
Patna High Court CR. MISC. No.66438 of 2022(2) dt.15-03-2023 2/2 following with the disclosure statement made by this petitioner from the house of one namely, Pappu Kumar but the said motorcycle was not concerned to the present case rather the same was concerned to Bihariganj P.S. Case No. 32 of 2021. Further submission is that the petitioner was not put on test identification parade after his arrest in the present matter and the investigation has been completed against him. Learned APP appearing for the State has opposed the bail prayer.
In view of the facts as stated above, the petitioner deserves to a lenient approach of this court. Accordingly, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Gwalpara (Ara O.P.)
