2. The petitioner apprehends his arrest in connection with Krishnagarh P.S. Case No. 42 of 2025, registered for the offences punishable under Sections 331(4) and 305(a) of the BNS.

While the informant and her daughter were away from their home for a few days during which the house remained unoccupied and upon their return on 31.03.2025, they found that several household articles, including one LG Television, two refrigerators, a washing machine, jewellery and other valuables have been stolen by unknown thief.

4. Learned Advocate for the petitioner submitted that prior to the institution of the present FIR, the petitioner's father

No.66595 of 2025(2) dt.17-09-2025 2/3 namely, Sumit Singh was murdered by the husband of the informant along with his son and brother-in-law leading to institution of Krishnagarh P.S. Case No. 8 of 2025. Only on account of previous enmity, during the course of investigation, the police implicated the name of the petitioner and further raided the ancestral house of the petitioner from where an old water motor and some wires along with drill machine were recovered; however these were not the subject matter of the theft nor they ever put on Test Identification Parade. The petitioner is a student aged about 18 years old and only on account of previous case, treating it as a motive, his name has been implicated without there being any cogent material.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioner bears one criminal antecedent, as has been disclosed in para-3 of the bail application.

Having considered the submissions set forth by the learned Advocates for the respective parties and taking note of the fact that the name of the petitioner has transpired during the course of investigation, based upon recovery of some so called articles, which was not the subject matter of theft, coupled with the fact that the petitioner is a student aged about 18 years,

No.66595 of 2025(2) dt.17-09-2025 3/3 besides the previous enmity, let the petitioner abovenamed be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Krishnagarh P.S. Case No. 42 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
