JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This is an application for grant of anticipatory bail in connection with Mohammadpur P. S. Case No. 56 of 2019, disclosing offences under Sections 341, 323, 324, 325, 379, 307, 427, 448, 504, 506, 34 of IPC.

As per F.I.R. petitioner and several other accused persons are named in the F.I.R. and there are specific allegation against other accused persons and so far this petitioner is concerned that he assaulted by Sword to the informant on his head, causing injury.

Submission of the learned counsel for the petitioner is that there is case and counter case between the parties and drawing my attention towards the impugned order. Even Sessions Judge has mentioned that there is case and counter case

Moreover, in the application the petitioner has stated on oath that injuries were found to be caused by hard and blunt substance and the same are lacerated, bruise, abrasion and swelling and are simple in nature. Heard learned A.P.P. also.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of two weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-1, Gopalganj, in connection with Mohammadpur P. S. Case No. 56 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
