JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-12-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Kudhni P.S. Case No. 730 of 2020, registered for the offence punishable under Sections 414/34 of the Indian Penal Code, Sections 25(1-B)a, 26/35 of the Arms Act and Sections 8/20/22 of the Narcotics Drugs and Psychotropic Substance Act, 1985 ('NDPS Act' for short).

This is the second attempt of the petitioner seeking prayer for regular bail. Similar prayer was earlier rejected by an order dated 06.04.2022 passed in Criminal Miscellaneous No. 62060 of 2021.

From the order of this Court dated 06.04.2022, it

Patna High Court CR. MISC. No.66656 of 2022(2) dt.07-12-2022 2/2 appears that the petitioner's prayer for his release on bail was rejected keeping in mind the statutory embargo under Section 37 of the NDPS Act. The said embargo still exists. I do not find any reason to take a different view than that was taken by this Court in the order dated 06.04.2022.

This application is accordingly rejected.
