The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 409,420,34 of the Indian Penal Code and Section 52 of the Relief Management Act, 2005.
According to FIR, petitioner-Taleswari Devi @ Taleshwari Devi being Ward Member of Madanpur Panchayat was Member of the Panchayat Anusharawan-cum-Nigrani Samiti, allowed Rs.6,000/- to go in the bank account of her son-Shyambabu Paswan as well as in account of the wife of
Patna High Court Cr.Misc. No.63791 of 2018(3) dt.06-12-2018 2/3 Shyambabu Paswan, namely, Subadhi Devipetitioner No.2, knowing well that both were family members of petitioner-Taleswari Devi @ Taleshwari Devi.
Submission is that the money has been transferred only in the account of Subadhi Devi and not in the bank account of Shyambabu Paswan. Subadhi Devi is separate from the family of Taleswari Devi @ Taleshwari Devi. Moreover, Shyambabu Paswan is already married and father of small children. Hence, he constitutes a separate unit. Petitioners have got no criminal antecedent.
Considering the facts of this case aforesaid, let the petitioners, above named, who are female, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Parsauni P.S.Case No. 66 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of
Patna High Court Cr.Misc. No.63791 of 2018(3) dt.06-12-2018 3/3 Criminal Procedure and further the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
