The petitioner apprehends his arrest for the offences alleged under Sections 304(B), 302, 201 and 34 Indian Penal Code registered in connection with Lalganj P.S. Case No. 311/2017.
It is submitted that the petitioner has been falsely implicated merely because he happens to be the husband of the deceased. The complaint petition has been filed belatedly on 31.07.2017 for the alleged occurrence of 20.07.2017 even though the complainant's family members came there on 24.07.2017. As a matter of fact, the deceased died owing to snake bite for which she was being treated (Annexure-2 series). The informant and the father of the petitioner participated in the
Patna High Court Cr.Misc. No.63447 of 2018(3) dt.04-02-2019 2/3 Panchayati held on 24.07.2017 (Annexure-3) in which no such allegations were made. The complaint has been filed thereafter as an aftermath. Petitioner who was working at Shilong was not present at the place of occurrence. Petitioner claims clean antecedent.
Learned A.P.P. has not pointed out any objective material against the petitioner in the case diary. Be that as it may, having regard to the entirety of the facts and circumstances, in the event of petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the abovenamed petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 311/2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and also subject to the following further conditions: (i) That one of the bailors shall be a close relative of the petitioner.
(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.
(iii) The petitioner shall be well represented in Court
Patna High Court Cr.Misc. No.63447 of 2018(3) dt.04-02-2019 3/3 on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned. (Vikash Jain, J) vinita/- U T
