The petitioner is apprehending his arrest in connection with Kishanganj P.S.Case No.129 of 2019 registered for offences punishable under Sections 17, 22, 27, 27(A), 29 of NDPS Act.

Petitioner is named in the FIR and as per the FIR two persons were arrested and from them 11.590 grams of smacks were recovered and they disclosed the name of the petitioner , who is also engaged in the smacks business.

Submission of the learned counsel for the petitioner is that except the confessional statement there is nothing against the petitioner and he has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.60668 of 2019(2) dt.24-09-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available against the petitioner, without being prejudiced by the order of this Court.

With the aforesaid direction, this application is dismissed.
